Shahara provides a Pay-Per-View (PPV) Video on Demand (VOD) service that allows our users to access entertainment content over the Internet to certain Internet-connected devices.

Quality of Content:

The quality of the display of Shahara content may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection. HD, Ultra HD and HDR availability is subject to your Internet service and device capabilities. Not all content is available in all formats, such as HD, Ultra HD or HDR and not all subscription plans allow you to receive content in all formats. The minimum connection speed for SD quality is 1.0 Mbps; however, we recommend a faster connection for improved video quality. A download speed of at least 3.0 Mbps per stream is recommended to receive HD content (defined as a resolution of 720p or higher). A download speed of at least 15.0 Mbps per stream is recommended to receive Ultra HD (defined as a resolution of 4K or higher). You are responsible for all Internet access charges. Please check with your Internet provider for information on possible Internet data usage charges. The time it takes to begin watching Shahara content will vary based on a number of factors, including your location, available bandwidth at the time, the content you have selected and the configuration of your device.

Changes to Terms of Use and Assignment: Shahara is constantly changing and improving the Service. We may also need to alter or discontinue the Service, or any part of it, in order to make performance or security improvements, change functionality and features, make changes to comply with law, or prevent illegal activities on or abuse of our systems. We will always consider and balance the impact of such changes on the use of the Service. Whenever reasonably possible, we will notify you at least 30 days before such changes apply to you. when we discontinue or make material changes to our Service that will have an adverse impact on the use of our Service. You, as an end-user agrees that Shahara and its information/content providers retain all proprietary right, title or interest, including copyright, in the stories, articles or other material, including but not limited to text, images, and other multimedia data, that Shahara provides (the "Content").

Disclaimer, Limitation of Liability:

Shahara does not warrant (a) that the services any of the services functions or any content will be uninterrupted or free of errors or omissions; (b) that the defects will be corrected. Shahara shall have no liability for any such issues. The provider parties disclaim any express or implied warranties including without limitation, noninfringement, merchantability, fitness for a particular purpose, and as to quality, availability, and subject matter of the content. The services, including all content and functions made available on or accessed through or sent from the services provided “as is”, “as available”, “with all faults”, and “at your own risk”. No advice or information obtained by you from us or from or through the site shall create any warranty.

Your access and use of the services including their functions and content is at your own risk, if you are dissatisfied with the service, you may discontinue accessing and using these services.

Shahara will not be liable for any failure or delays in its performance due to any cause beyond its reasonable control including acts of war, act of God, active third-party service providers, earthquakes, floods, embargo, riot, sabotage, labor shortage or dispute, governmental act, power failure or failure or the of the Internet or computer equipment.

Shahara will not be liable to you or anyone else for any special, indirect, incidental, exemplary, punitive, or consequential damages in connection with the services. In no event will Shahara liability for other damages exceed the amount paid by you to Shahara, for access the relevant service or for purchase for the relevant product.

You acknowledge and agree that if you incur any damages but a rise out of Shahara’s act or omissions, that damages, if any are not irreparable and are not sufficient to entitle you to an injunction or any other equitable relief restricting operation of the service or on any other service, property, product, program, television show, motion picture or other content owned or controlled by Shahara.

Content Library

The Shahara service, including the content library, is regularly updated. Unless specifically stated otherwise, content on Shahara will be on the platform for a minimum of 6 months and once purchased the content, you shall have the ability to access and watch the relevant purchased content an unlimited number of times over the 12-month period.

Where specifically stated otherwise that content will be accessible on Shahara for a specific period, once purchased you will have the ability to access and watch the content an unlimited number of times for the duration which is specified that the content will be accessible on Shahara.

Restrictions on Use:

As an end-user, you agrees that you will not copy nor license, sell, transfer, make available or otherwise distribute the Content to any entity or person. You shall use its best efforts to stop any such copying or distribution immediately after such use becomes known.

As an End-User You are not allowed to:
Access, reproduce, download, distribute, transmit, broadcast, display, sell, license, alter, modify, or otherwise use any part of the Service or any Content.
Circumvent, disable, fraudulently engage with, or otherwise interfere with the Service (or attempt to do any of these things), including security-related features or features that: (a) prevent or restrict the copying or other use of Content; or (b) limit the use of the Service or Content.
Access the Service using any automated means (such as robots, botnets or scrapers) except; (a) with Shahara’s prior written permission; or (b) as permitted by applicable law.
Collect or use any information that might identify a person (for example, harvesting usernames or faces), unless permitted by that person.

Dispute Resolution:

If you have any dispute or claim against us or any of our affiliates arising out of or relating in any way to the services or this terms and the claim is not resolved by calling our customer care, you and we each agree to resolve such disputes through an individual binding arbitration. Before you commence an arbitration with respect to your claim you must first send to us a written notice of your claim the notice must be sent by email or by certified mail be addressed to Shahara and attention to the legal department. The notice must describe the nature of your claim and specify the damages or other relief you seek. If we and you do not then resolve the claim within 30 days after receipt of your notices received either you or we may commence an individual binding arbitration to resolve the claim.
